1. Agreement to Terms
By creating an account or using Vocalog ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
If you do not agree to these Terms, do not use the Service.
2. Eligibility
You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement.
3. Description of Service
Vocalog is a voice-to-report platform for trade professionals. The Service allows you to:
- Record audio descriptions of job-site activity
- Capture photos during recordings
- Receive AI-generated structured reports from your recordings
- Organize reports by property and share with team members
- Export reports in various formats
4. Your Account
You are responsible for maintaining the security of your account credentials. You agree to notify us immediately of any unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account.
5. Your Content
You own your content. You retain all ownership rights to your audio recordings, photos, transcripts, and any content you create through the Service ("Your Content").
By using the Service, you grant us a limited, non-exclusive license to process, store, and transmit Your Content solely to provide and improve the Service. This license ends when you delete Your Content or your account.
You represent that you have the right to record any audio and capture any photos you submit through the Service, and that Your Content does not violate the rights of any third party.
6. AI-Generated Content
The Service uses artificial intelligence to transcribe audio and generate structured reports. You acknowledge and agree that:
- AI output may contain errors. Transcriptions and generated reports are produced automatically and may be inaccurate, incomplete, or misleading. You are solely responsible for reviewing and verifying all AI-generated content before relying on it.
- No professional advice. AI-generated reports do not constitute professional, legal, or safety advice. They are tools to assist your documentation workflow.
- Your data is not used for AI training. Your recordings, transcripts, and reports are not used to train AI models.
7. Subscriptions & Billing
7.1 Free Tier
The free tier provides limited access to the Service. Feature limits are described on our pricing page and may change at our discretion.
7.2 Paid Subscriptions
Paid plans are billed on a recurring basis (monthly or annually) through Stripe. By subscribing, you authorize us to charge your payment method at the beginning of each billing cycle.
7.3 Cancellation
You may cancel your subscription at any time from the Settings page. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period you have already paid for.
7.4 Refunds
Payments are generally non-refundable. If you believe you have been charged in error, contact us at support@vocalog.io within 14 days of the charge and we will review your request.
7.5 Price Changes
We may change subscription prices with at least 30 days' notice. Price changes take effect at the start of your next billing cycle after the notice period.
8. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation
- Record audio of others without their consent where required by law
- Upload content that is illegal, harmful, threatening, abusive, or harassing
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service or its infrastructure
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use the Service for any purpose it was not designed for
We reserve the right to suspend or terminate your account for violations of this section.
9. Intellectual Property
The Service, including its design, code, features, and branding, is owned by Vocalog and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding.
10. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue the Service (or any part of it) at any time with reasonable notice. We are not liable for any downtime, data loss, or interruptions.
11. Account Deletion
You may delete your account at any time from the Settings page or by contacting us. Upon deletion, we will remove your personal data, recordings, photos, and reports within 30 days, except where retention is required by law.
12. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free, secure, or uninterrupted, or that AI-generated content will be accurate or complete.
13. Limitation of Liability
To the maximum extent permitted by law, Vocalog shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, arising out of or related to your use of the Service, regardless of the theory of liability.
Our total liability for any claims arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless Vocalog and its officers, employees, and agents from any claims, damages, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
15. Governing Law & Disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Massachusetts.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new effective date. For significant changes, we may also notify you via email or in-app notification. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
17. General
- If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
- Our failure to enforce any provision is not a waiver of that provision.
- These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vocalog.
- You may not assign your rights under these Terms without our written consent.
